Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and JobChatter ("we," "us," or "our"), concerning your access to and use of our website and AI chatbot service.

You agree that by accessing the site and using our services, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the site and services and must discontinue use immediately.

Services

JobChatter provides an AI-powered chatbot service designed for local service-based businesses to automate customer interactions, streamline job management, and free up owners to focus on their core work.

We reserve the right to withdraw or amend our service, and any service or material we provide via the service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the service is unavailable at any time or for any period.

Intellectual Property Rights

Unless otherwise indicated, the site and services are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

Provided that you are eligible to use the site and services, you are granted a limited license to access and use the site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.

User Representations

By using the site and services, you represent and warrant that:

2. You will maintain the accuracy of such information and promptly update such registration information as necessary.
3. You have the legal capacity and you agree to comply with these Terms of Service.

6. You will not use the site or services for any illegal or unauthorized purpose.
7. Your use of the site or services will not violate any applicable law or regulation.

Fees and Payment

We charge fees for the use of our services as described on our pricing page. You agree to pay all fees and charges associated with your account on a timely basis and in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable.

You are responsible for paying all fees and charges associated with your account and for all applicable taxes. All fees are non-refundable unless otherwise stated in these Terms or required by applicable law.

Free Trial

We offer a 14-day free trial to new users who register with the service. The trial period may be subject to additional terms that will be presented to you during the registration process.

At the end of the free trial period, you will be automatically charged according to the pricing plan you selected unless you cancel your subscription before the end of the trial period.

Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or services, even if we have been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of your use of the site or services.

Term and Termination

These Terms of Service shall remain in full force and effect while you use the site or services. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service.

Upon termination, your right to use the site and services will immediately cease. If you wish to terminate your account, you may simply discontinue using the site and services.
